Constitution Day of India 2024: Understanding the Fundamental Duties

Every year on November 26, India commemorates Constitution Day, marking the adoption of the Constitution of India in 1949. This day is dedicated to celebrating the vision of the framers of the Constitution who laid the foundation of a democratic republic, ensuring justice, liberty, equality, and fraternity for every citizen.

As Ms Priya Rana, Social Science Teacher at Apeejay School, Rama Mandi, rightly said: “On Constitution Day, we celebrate the spirit of unity and equality that binds us as a nation. Our Constitution is not just a legal document; it is the foundation of our democracy, the protector of our rights, and the beacon that guides India toward justice and progress.”

While much attention is often given to the rights of citizens, it is equally important to recognise the Fundamental Duties enshrined in the Constitution of India. These duties, outlined in Part IVA (Article 51A), emphasise the moral and ethical responsibilities of citizens to contribute to the nation’s progress and well-being.

The concept of Fundamental Duties was introduced by the 42nd Amendment Act of 1976, which added a total of 10 Fundamental Duties under Part IV of the Constitution. This amendment was inspired by the Constitution of the former Soviet Union, which included a list of duties for citizens. While the Indian Constitution initially focused on guaranteeing Fundamental Rights to citizens, it was recognised that for the nation to thrive, citizens must also have clear responsibilities.

In 2002, the 86th Constitutional Amendment Act added an 11th Fundamental Duty, further emphasising the importance of education and responsible citizenship. Ms Rana elaborates on the significance of this day: “Constitution Day reminds us of the power of our democracy, the rights it grants, and the responsibilities it upholds. It is a day to honour the vision of our founding fathers and renew our commitment to building a just, inclusive, and prosperous nation for all.”

The 11 Fundamental Duties

The Constitution of India lists 11 Fundamental Duties under Article 51A. These duties aim to foster a sense of responsibility, respect for the Constitution, and contribute to the overall development of the nation. Here’s a brief look at these duties:

To Abide by the Constitution: Respect the ideals and institutions of the Constitution, including the National Flag and the National Anthem.

To Cherish the Noble Ideals of the Freedom Struggle: Uphold the values and principles that inspired the national struggle for independence.

To Uphold the Sovereignty and Integrity of India: Protect and defend the unity, integrity, and sovereignty of the nation.

To Defend the Country: Render national service when called upon, particularly in defence of the country.

To Promote Harmony and Brotherhood: Foster the spirit of unity across India, transcending religious, linguistic, regional, or sectional diversities, and renounce practices that undermine the dignity of women.

To Value and Preserve Cultural Heritage: Appreciate and preserve the rich diversity of India’s composite culture.

To Protect the Environment: Contribute to the preservation of the natural environment, including forests, lakes, rivers, and wildlife, while cultivating compassion for all living creatures.

To Develop Scientific Temper: Promote humanism, scientific inquiry, and a spirit of reform and improvement.

To Safeguard Public Property: Protect public property and discourage violence in all forms.

To Strive for Excellence: Continuously aim for excellence in all individual and collective endeavours, helping the nation rise to new levels of achievement.

To Provide Education for Children: For parents or guardians, provide opportunities for education for children aged 6 to 14 years.
