India’s AI patent grant ratio remains low despite surge in filings

India has witnessed a significant surge in artificial intelligence (AI)-related patent filings over the past 15 years, with over 86,000 AI patents filed between 2010 and 2025—accounting for more than 25% of all technology patents in the country. However, the grant ratio remains alarmingly low at just 0.37%, as per Nasscom’s latest report, Patent Pulse 2025 – Decoding India’s Ascent in AI Patent Landscape.

Despite increased activity from educational institutions, their filing-to-grant ratio stands at only 1%, compared to a 40% success rate for corporates. Nasscom attributes this disparity to a lack of robust R&D, institutional support, and focus on high-quality intellectual property.

Rajesh Nambiar, President of Nasscom, noted that although India has improved its intellectual property infrastructure, issues such as lengthy patent approval timelines and lower-quality filings hinder progress when compared to global leaders like the US and China.

Machine Learning (ML) dominates India’s AI patent landscape, making up over 55% of filings, with Generative AI (GenAI) emerging as a key innovation driver. Notably, GenAI constitutes 28% of India’s AI filings—well above the global average of 6%—placing the country among the top five worldwide in this domain.

Functional AI applications, particularly Computer Vision and Natural Language Processing, make up over 90% of India’s AI patents. Sector-wise, transportation leads, with over 70% of all AI filings. 

India remains the fifth-largest contributor to global patent filings. The nation’s patent-to-GDP ratio rose from 144 in 2013 to 381 in 2023, while its share in global granted patents jumped to 3.8% in 2023 from 1.7% in 2022. FY24 marked a record year, with over 90,000 patents filed and more than 100,000 granted—nearly a threefold increase over the previous year.
